Trikiink Photography or any third party photographer are protected by
Copyright Law and “The Berne convention”. http://www.referenceforbusiness.com/encyclopedia/Assem-Braz/Berne-Convention.html. 2. Images may not be reproduced or copied by any means without the express written permission of Steve Hutchins and Trikiink Photography. Copyright ownership extends to seventy years after the death of the copyright owner (see Berne convention link above). The conditions for the supply of digital files and paper based photographs are as follows. To supply digital files 3. The files may be used for your own personal use and cannot be reproduced or published in any form without the written consent of the copyright holder, i.e. Steve Hutchins, Trikiink Photography or any third party photographer. Your full name, address and telephone number must be submitted with each order for digital files. You may pay by cash, credit card or PayPal. 4. Usually, there will be no additional fee to be paid for use in your own club magazine, your personal web site. So far as, the images are not used for financial gain. (This does not include Business websites.) However, written permission MUST be obtained BEFORE such use and a copy of the magazine MUST be sent to us. A credit MUST be printed under each image in any publication and credit with a link to our web site if used on your personal web site. We also require the address of the web site where the image will be displayed. You may not sell, rent, loan, give, sublicense or in anyway transfer to anyone an image, or the right to use them. You may not grant any third party the right to use or duplicate an image. You agree to take all reasonable steps to prevent third parties from duplicating or distributing the images. You may not post any image or images from this site on any electronic bulletin board, put the images online in a downloadable format, or use the images in a website at a resolution higher than 72dpi. 5. The file(s) may not be sent to commercial publications for use in magazines or other media types in any way. This includes Business websites. “Yourself” (the purchaser) may inform the magazine to contact Steve Hutchins and Trikiink photography to negotiate the use of the artistic media and its purpose. You will be entitled to a commission if the image is of yourself. The file may be used in a book. Reproduction fees will be negotiated for each individual publication plus a copy of the book, article or magazine publication will be submitted to Steve Hutchins and Trikiink Photography. To supply paper based photographs Copyright conditions also apply to paper based photographs supplied by Steve Hutchins and Trikiink Photography. Or any third party photographer. If you have purchased a paper based photograph it may be scanned for your own personal use on your personal web site without additional fees being due. All previous Conditions apply. If you submit a paper based photograph to a magazine or book publisher condition 5 applies. Disclaimer Steve Hutchins and Trikiink Photography in no way indorse any brand name, or person represented within the artistic media, represented on Steve Hutchins and Trikiink Photography. Any representation is purely coincidental, unless specified. Damages IN NO CASE SHALL Steve Hutchins and Trikiink Photography BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, COVER OR CONSEQUENTIAL DAMAGES OR LOSS, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOSS OF BUSINESS, BUSINESS INTERRUPTION OR THE INABILITY TO USE EQUIPMENT OR ACCESS DATA, WHETHER SUCH DAMAGES ARE BASED UPON A BREACH OF EXPRESS OR IMPLIED WARRANTIES, BREACH OF CONTRACT, NEGLIGENCE, STRICT TORT, PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY. THIS IS TRUE EVEN IF Steve Hutchins and Trikiink Photography IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO CASE WILL Steve Hutchins and Trikiink Photography LIABILITY UNDER ANY LEGAL THEORY EXCEED THE AMOUNT OF THE LICENSE FEE ACTUALLY PAID BY YOU TO Steve Hutchins and Trikiink Photography. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE WARRANTIES IN THIS AGREEMENT FAIL OF THEIR ESSENTIAL PURPOSE. Legal Costs And Jurisdiction In the event that either a court of competent jurisdiction directs us to go to court, or the matter involves copyright, you agree to fully reimburse Steve Hutchins and Trikiink Photography for their reasonable legal fees and disbursements if Steve Hutchins and Trikiink Photography are successful in the suit. YOU’RE ACCEPTANCE AND PAYMENT FOR ANY IMAGE(S) CONSTITUTES YOUR CONSENT TO AND ACCEPTANCE OF THE FOREGOING IMAGE LICENSE. I have read, understood and agree to abide by the terms and conditions
stated above. I realise that infringement of copyright is a criminal
offence and a prosecution may result in a custodial sentence and compensation
costs. I also understand that infringement of Steve Hutchins’
Trikiink Photography’s or any third party photographers’
copyright is theft of Steve Hutchins income. |
